Terms of Use
Oui! Learn French
Please read carefully
These Terms of Use (the Terms) govern your use of the Oui! Learn French mobile application (the Service). By downloading, accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Publisher
The Service is published by HEYATECH, a French simplified joint-stock company (société par actions simplifiée) with variable capital, registered with the Paris Trade and Companies Register (RCS) under number 993 329 739, with its registered office at 142 rue de Rivoli, 75001 Paris, France (the Company, we, us). Contact: contact@heyatech.fr.
2. Definitions
- Application means the Oui! Learn French software downloaded on any electronic device.
- Application Store means the Apple App Store or the Google Play Store, from which the Application is downloaded.
- Premium Content means the lessons, chapters and features that require a paid Subscription.
- Subscription means paid access to the Premium Content for a fixed period that renews automatically.
- You means the individual using the Service.
3. Acceptance and eligibility
You must be at least 18 years old to use the Service. By using it, you confirm that you meet this requirement and that you have read our Privacy Policy, which explains how we process your personal data.
4. The Service
Oui! Learn French helps you learn French through short lessons, exercises and pronunciation practice. The first chapter is available for free. Access to the rest of the content requires a Subscription.
We may improve, update or change the content and features of the Service at any time. If a change substantially reduces the Premium Content included in your current Subscription, you may cancel it and, where the law provides for it, obtain a refund for the unused period.
5. Your account
An account is created automatically when you start using the Application, and you can sign in with your Google account to save and sync your progress. You are responsible for keeping access to your sign-in method secure. You can delete your account at any time from the Profile tab of the Application. Deleting your account does not cancel a Subscription purchased through an Application Store: you must cancel it in your store settings.
6. Subscriptions and payment
The available plans, their duration and their price (including taxes) are shown in the Application before you confirm your purchase. Free trials, when offered, convert into a paid Subscription at the end of the trial unless you cancel before it ends.
Purchases through the App Store or Google Play
- Payment is charged to your Apple ID or Google account at confirmation of purchase. Billing and payment are handled by the Application Store under its own terms.
- Your Subscription renews automatically at the end of each period unless you turn off auto-renewal at least 24 hours before the end of the current period.
- You can manage or cancel your Subscription at any time in your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current period.
- Refund requests are handled by the Application Store according to its own policies. Any unused portion of a free trial is forfeited when you purchase a Subscription.
7. Right of withdrawal (EU and UK consumers)
As a consumer in the European Union or the United Kingdom, you normally have 14 days from your purchase to withdraw from a contract concluded at a distance.
Subscriptions are purchased through the Application Stores, which handle withdrawal and refund requests under their own terms. As the Premium Content is digital content supplied immediately after purchase, the right of withdrawal may no longer apply once access has started, if you requested immediate access and acknowledged this when purchasing (Article L221-28, 13° of the French Consumer Code).
8. License and acceptable use
We grant you a personal, non-exclusive, non-transferable and revocable license to use the Service for your own private, non-commercial learning. You agree not to:
- copy, extract, download, record, redistribute or resell the content of the Service;
- reverse engineer, decompile or attempt to access the source code of the Application, except where permitted by law;
- circumvent payment, access controls or security measures;
- use the Service in a way that is unlawful, harmful or that disrupts its operation.
9. Third-party services and links
The Service relies on third-party services (for example Google Sign-In and the Application Stores) and may contain links to third-party websites. Your use of these services is subject to their own terms and privacy policies. We are not responsible for their content or practices.
10. Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you seriously breach these Terms, after informing you where possible. If we terminate the Service for reasons not attributable to you, you may request a refund of the unused period of your Subscription from the Application Store.
11. Warranty
We make reasonable efforts to keep the Service available and working, but we do not guarantee that it will be uninterrupted or error-free, or that it will achieve a particular learning result. If you are a consumer, you benefit from the legal guarantee of conformity for digital content and services (Articles L224-25-12 and following of the French Consumer Code) and from any other mandatory protection under the law of your country of residence. Apart from these legal guarantees, the Service is provided “as is” to the extent permitted by law.
12. Limitation of liability
To the extent permitted by law, our total liability towards you is limited to the amount you paid for the Service during the 12 months preceding the event giving rise to the claim, and we are not liable for indirect damages such as loss of data, profit or opportunity. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for gross negligence or willful misconduct, or any liability that cannot be limited under applicable law.
13. Application Store terms
These Terms are concluded between you and the Company only, not with Apple or Google. Apple and Google are not responsible for the Application, its content, maintenance or support. If you downloaded the Application from the Apple App Store, you also agree to Apple's Licensed Application End User License Agreement, and Apple and its subsidiaries are third-party beneficiaries of these Terms. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Application.
14. Governing law and disputes
These Terms are governed by French law. If you are a consumer residing in another country, you also benefit from the mandatory provisions of the law of your country of residence.
If you have a complaint, please contact us first at contact@heyatech.fr so we can try to resolve it. Failing an amicable solution, the dispute will be brought before the competent French courts, without prejudice to your right as a consumer to bring proceedings before the courts of your place of residence.
15. United States legal compliance
You represent that you are not located in a country subject to a United States government embargo, and that you are not listed on any United States government list of prohibited or restricted parties.
16. Miscellaneous
If any provision of these Terms is held invalid, the remaining provisions remain in full force. Our failure to enforce a right does not waive it. These Terms are available in English and French; for consumers residing in France, the French version prevails in case of discrepancy, and otherwise the English version prevails.
17. Changes to these Terms
We may update these Terms, for example to reflect changes to the Service or to the law. We will inform you of any material change at least 30 days before it takes effect, in the Application or by email. If you do not agree, you can cancel your Subscription and stop using the Service before the change applies.
